Your privacy is important to us. After all, when you call on Encantada and transfer your data, you are communicating personal data to us. You should then be able to trust us to handle this data carefully and confidentially. This Privacy Policy tells you how Encantada does this.

This Privacy Policy also applies to the website www.encantada.es operated by Encantada, at 17476 Palau de Santa Eulàlia, Carrer Nord 1 (referred as “Encantada” or “we”).

By using our services and our website, you unconditionally acknowledge having read Encantada’s Privacy Policy. We may change the Privacy Policy at any time. We therefore encourage you to regularly review this Privacy Policy.

What personal data do we process?

If you are a customer, we process the following personal data from you, or – if you are a professional customer – from your designated contact person within your company:

  • name and contact details (address, phone number, e-mail);
  • function;
  • notes of discussions, e-mail exchanges;
  • all data, personal or otherwise, that you provide to us for posting on your website or within the framework of a campaign.

If you are a supplier, we will process the name, contact details and position of your employees and/or appointees, as well as any other information they provide in connection with the services we are providing to you.

If you are a candidate-employee, we process the data you provide in your curriculum vitae and cover letter, as well as the data you provide during the interview. Unless in the case of a spontaneous application or unless you give us your consent, we process this data only for the purpose of filling the position you are applying for.

Furthermore, we process the content of every communication for as long as it is necessary to provide you with our services and to safeguard our interests (such as, for example, our liability or for the purpose of pursuing our rights).

How do we collect personal data?

We collect personal data when you communicate it to us, either verbally or in writing, whether through our website or otherwise.

When you provide us with information about third parties, we process it in the same way as we process your own personal data as explained in this Privacy Policy. In that case, however, you pledge that you yourself, when processing and collecting this personal data, have meticulously complied with the General Data Protection Regulation and that the third parties have given you, if necessary, permission to pass on that information to us for processing.

What do we use your personal data for?

We use the personal data that you communicate to us:

How long will your personal data be kept?

Encantada retains your personal data for as long as necessary to provide you with our services or for other essential purposes, such as meeting our legal obligations.

Data will be deleted 10 years after the termination of any collaboration or after the last contact between us, except in case of an ongoing dispute.

If you are a prospective employee we will retain your data for 6 months after the vacancy you applied for has been filled, unless you give your consent to include the data in our recruitment reserve.

Is your personal data safe with us?

We have taken the necessary physical, technical and organizational security measures to effectively protect your personal data from unauthorized access and use and disclosures.

For example, only authorized persons are granted access to your personal data, after entering username and password, including encryption via SSL technology.

Our website contains links to other websites. This Privacy Policy applies only to our own website. Therefore, we encourage you to consult the other websites’ Privacy Policy. We are not liable for the privacy policies of other websites, even if you visit this website through one of the links on our website.

What are your rights?

  • Right of access, correction and supplementation
    You can exercise the right to access, correct and supplement your personal data at any time. This can be done by sending a request with a copy of your identity card to informe@encantada.es.
  • Right to transferability
    You have the right to receive the personal data you have given us in a structured, common and machine-readable form, with or without the intention of transferring the personal data to another party.
  • Right to erase data
    You can exercise the right to erase personal data at any time. This can be done by sending a request with a copy of your identity card to informe@encantada.es.
    Following such request, we will only continue to process these personal data to the extent that we have a valid reason to do so or if this would be necessary to comply with a legal obligation.
  • Withdrawal of consent
    If the processing is based on your consent, you may withdraw this consent – in whole or in part – at any time. However, this may mean that we can no longer provide you our services. This can be done by sending a request with a copy of your identity card to informe@encantada.es.
  • Right to object and complaints
    If you wish to object to the processing, have a request, question or complaint about the processing of your personal data, you may send it to informe@encantada.es, with a copy of your identity card. We undertake to give a timely response to these requests and complaints.
    In addition, if you feel that any of your rights have not been respected, you may also file a complaint with the Belgian Data Protection Authority at contact@apd-gba.be ( www.gegevensbeschermingsautoriteit.be).

Data breach

If a data breach is detected at your premises, you must report it immediately to Encantada.
